Best AI Patent Drafting Software 2026: 6 Tools Compared
There is no single best AI patent drafting software in 2026. The market has split into three distinct jobs turning a disclosure into first draft claims, expanding claims into a full specification, and reviewing a draft against examination rules and most vendors are strong at one. This comparison holds every tool, including ours, to the same fields, with sources, output formats for the USPTO, EPO and Indian Patent Office, and one shared review date.
Key takeaways
Match the tool to the job, not the ranking. PatentPal expands claims into a specification. Solve Intelligence and DeepIP are built around IP firm workflows. Patlytics leans analytics. PatentProtector.ai is aimed at inventors and startups who need a filing ready first draft.
Published pricing is the exception. A PatSnap review we checked in August 2026 found DeepIP, XLSCOUT and PatentPal publish no prices at all, so most cost figures online are third party estimates.
AI can help draft claims, but inventorship stays with named humans. The USPTO's revised AI inventorship guidance, issued in November 2025, rescinds the February 2024 version and treats AI systems as tools.
Filing format rules bite harder than drafting quality. Since August 2026, the USPTO's Patent Center converts DOCX directly to TIFF, and you can review the TIFF before filing.
Security certification is the field most comparison tables leave blank. Ask for SOC 2 Type II, ISO 27001 and ISO 42001 the last is the AI-specific one.
What is the best AI patent drafting software in 2026?
There is no universal winner. For a solo inventor filing a first provisional, PatentProtector.ai is built for that job; for a startup, DeepIP or PatentProtector.ai; for in-house IP teams, Solve Intelligence and DeepIP; for IP firms, Solve Intelligence and Patlytics, with PatentPal for claim to spec work.
Short version by user type:
Solo inventor, first filing: a tool with a genuine free tier. You are testing whether your idea is describable in claim language before you spend anything.
Startup founder building a portfolio: a tool with export formats that match your filing office, plus a prior art scan you can hand to counsel.
University tech transfer office: disclosure intake and first draft generation, then human review do not automate the inventorship determination.
IP firm: a drafting environment that sits inside Word, integrates with your docketing, and shows you its security posture.
How do the main AI patent tools compare side by side?
Every row below was checked in October 2026 against the linked source. Where a vendor does not publish a price, the figure is labelled a third-party estimate and the derivation is shown.
Tool | Primary job | Output & jurisdiction formats | Pricing (checked October 2026) | Security & compliance | Scale / funding |
|---|---|---|---|---|---|
PatentPal | Claim-to-spec expansion: claim set → flowcharts, diagrams, description | Word, Visio, PowerPoint export; not a first-draft claim engine | No public price table; a third party estimates ~$50/user/month | Not published in the comparison tables we checked | Founded 2018; small team; ~$250K seed (PitchBook) |
Solve Intelligence | End-to-end drafting and prosecution support for firms | Word-based workflows; US and EU data residency | No published rate. A third party back-calculated ~$9,300/user/yr after removing an assumed 15% NAPP member discount | Founded 2023; ~50 staff; $40M Series B (Dec 2025); total cited at $52.5M–$55M; 700+ IP firms and in-house teams | |
DeepIP (formerly DaVinci) | Word-native drafting and office action workflows | Word add-in; full format list not published | $350–420/user/month cited by a third party; confirm with the vendor | Not published in the tables we checked | Founded 2023, New York; ~$40M raised (same source) |
Patlytics | Patent analytics, drafting support and litigation intelligence | Not a filing-export-first tool | No public estimates (patentext) | Founded 2024; $40M Series B, 8 April 2026, led by SignalFire; ~$65M total | |
PowerPatent | Token-based drafting of applications | Export formats not published | Third-party check: 200 tokens for $199; $1/token; 6-month expiry; 10-token minimum | Not published | Not published |
Guided disclosure → prior art scan (Espacenet/EPO-OPS and Lens.org) → AI-drafted specification and claims → export | Word-like editor; USPTO, EPO and IPO output formats | Free provisional specification to start; paid plans on the pricing page | SOC 2 Type II; ISO 27001; ISO 42001; GDPR; 5-star Trustpilot | 1000+ patents drafted; 98% satisfaction rate; 1400+ inventors |
A caveat on the blanks: "not published" is not the same as "not certified". It means the vendor does not state it publicly, and you should ask directly before uploading anything confidential.
Which AI tools can actually write patent claims?
All three claim drafting jobs exist as separate products first-draft claim generation, claim-to-spec expansion, and AI review and no single tool in this comparison does all three well. Before you upload a disclosure, ask which of these it actually does.
Job | What it produces | What to ask the vendor |
|---|---|---|
First-draft claim generation | An independent claim and dependent claims from a plain-English disclosure | Does it build a claim tree with antecedent basis, or generate independent claims only? |
Claim-to-spec expansion | A description, figures list and reference numerals built from an existing claim set | Where does added subject matter come from? Does every claim term appear in the description? |
AI review | Comments against MPEP or EPO Guidelines: claim clarity, support, unity | Is the review rule-based, model-based, or both and who validated it? |
The inventorship question sits above all three. Under the USPTO's revised guidance issued in November 2025, AI systems are treated as instruments, similar to lab equipment. The earlier Pannu factors have been withdrawn from the AI context, and the traditional conception standard governs: a named inventor must be able to describe the invention with particularity. Two practical consequences:
The Application Data Sheet must list natural persons only.
A foreign priority application naming an AI tool as sole inventor will not support a US priority claim.
This is examination guidance rather than binding law, so it can change. Treat it as the current default and confirm your filing position with a registered practitioner. We cover the mechanics in Can AI Write a Patent Application? USPTO Rules (2026).
What does each tool cost in 2026?
Published list prices are the exception. As of October 2026, PowerPatent is the only tool in this comparison with public per draft pricing, and PatentProtector.ai is the only one offering a full provisional draft before payment. Everything else routes you to a demo or a quote.
Tool | Free tier | Per seat | Per draft / credits | Enterprise |
|---|---|---|---|---|
Get provisional specification | See /pricing | - | Plans listed on the pricing page | |
PatentPal | No published free tier; a third-party review checked in August 2026 reported its "Invent" open alpha had ended | ~$50/user/month (third-party estimate) | - | Not published |
Solve Intelligence | A "Free" tag appears on one directory listing while the vendor's own pricing is demo-led treat the tag with caution | ~$9,300/user/yr (third-party back-calculation) | - | Demo-led quote |
DeepIP | None published | $350–420/user/month (third-party citation; confirm with vendor) | - | Quote |
Patlytics | None published | No public estimate | - | Quote |
PowerPatent | None published | - | 200 tokens for $199; $1/token; 6-month expiry; 10-token minimum (third-party check) | - |
For context, here is what the US government charges, as of October 2026 (the USPTO fee schedule was last revised 14 August 2026). Fees are set by statute and rule and can change, so check the USPTO fee schedule before you pay:
US provisional application filing fee: $325 undiscounted, $130 small entity, $65 micro entity (USPTO fee schedule; entity status under 37 CFR 1.27 and 35 U.S.C. § 123).
US non-provisional utility, combined filing + search + examination (electronic): $2,000 undiscounted, $800 small entity, $400 micro entity (USPTO fee schedule).
Micro-entity income threshold: gross income at or below $251,190 for the preceding calendar year, certified on form SB/15A (USPTO fee schedule; 35 U.S.C. § 123).
One warning worth repeating: a false small or micro entity claim can trigger a penalty of at least three times the underpaid fee under 37 CFR 1.27 and 1.29.
So can software reduce the cost of a US provisional? On the drafting side, yes a $130 government fee plus a free draft versus the same fee plus paid drafting time. It does not reduce the government fee, and it does not remove the case for a professional read-through before you file. Our fuller breakdown is in Provisional Patent Cost in 2026: USPTO Fees and Budget.
Which tool fits an independent inventor, a startup, a university tech transfer office or an IP firm?
Individual inventors and early startups should prioritise a free entry point and output formats that match their filing office. Firms should prioritise Word integration, docketing, and audit-ready security documentation the things that make a tool usable across dozens of matters.
User | What they actually need | Reasonable starting point |
|---|---|---|
Independent inventor | A describable claim set, a prior art check, low or no upfront cost | PatentProtector.ai's free draft at /free-access; a general-purpose LLM plus a template if the idea is early-stage |
Startup / founder | Speed to a provisional filing date, USPTO or IPO format, something counsel can improve | PatentProtector.ai; DeepIP if the team works entirely inside Word |
University tech-transfer office | Disclosure intake, consistent first drafts, clear inventorship records | Solve Intelligence or DeepIP for volume; keep inventorship decisions with humans |
IP firm | Drafting inside Word, analytics, security certifications on file | Solve Intelligence and Patlytics; PatentPal for claim-to-spec diagramming |
US filers can see how the format options map to USPTO practice on the US page.
Can you file an AI-drafted specification at the USPTO, EPO or Indian Patent Office?
Format rules decide this, not the drafting tool. The USPTO requires DOCX for the specification, claims and abstract of utility non-provisional applications, and since August 2026 converts DOCX straight to TIFF with a pre-filing preview. The EPO sets no AI-specific format rule but places responsibility for the document squarely on the applicant. India runs a two-stage provisional-then-complete route.
USPTO
The agency has required DOCX for the specification, claims and abstract of utility non-provisionals since January 2024, with a non-DOCX surcharge that appears in the current fee schedule. Its August 2026 notice changed the pipeline: Patent Center no longer converts DOCX to PDF before submission it converts DOCX to TIFF, and you can review that TIFF before filing. A PDF copy can be downloaded after submission. Practical consequence: check the TIFF preview for equation, chemical structure and claim-numbering drift, which is exactly where exported DOCX files break. The USPTO also flagged longer-than-expected delays for DOCX uploads appearing in the Documents and Transactions tab from 18 August 2026.
EPO
The Guidelines for Examination 2026, in force from 1 April 2026, contain the first dedicated section on artificial intelligence. The core principle: parties remain responsible for the content of their applications regardless of whether an AI tool helped prepare them. Two other 2026 changes matter to a draft's substance: G 1/24 confirms that claim interpretation always refers to the description and drawings, and the guidelines expand on insufficient disclosure for AI and machine-learning inventions, where training datasets must be disclosed well enough to reproduce the result.
Indian Patent Office
India runs a two-stage route: a provisional specification followed by a complete specification, filed on Form 1 (application) and Form 2 (specification), with separate fee categories for natural persons, startups and small entities. The 12-month window for filing the complete specification is set by Section 9 of the Patents Act 1970. Confirm the current rupee amounts on the IPO's own fee schedule before you budget we do not quote them here because published figures change. Indian filers can see how the format options map to IPO practice on the India page.
What should you check before uploading your invention to any AI tool?
Work through this list before you type a word of the disclosure. A vendor that cannot answer these questions in writing is not ready for confidential material.
Certifications to ask for
SOC 2 Type II an independent audit of controls, not a self-declaration.
ISO 27001 information security management.
ISO 42001 AI management systems; the AI-specific one.
GDPR posture, and whether a data processing agreement is available.
Data handling and residency
Retention and training policy: is your disclosure used to train models, how long is it kept, and can you delete it? One published comparison found PowerPatent's policy silent on training, with its local-processing guarantee scoped only to its Word add-in.
Data residency options if you have EU or UK inventors.
Export controls and sanctions screening if your team spans borders.
Human review and contract terms
Human review available is there a route to a registered patent professional?
Enforceable confidentiality: most vendor terms carry accuracy disclaimers and state that outputs are not a substitute for professional judgement, and that the vendor is not a law firm. That is the industry norm, and it is also your signal to keep a human in the loop.
You can see how these controls appear in practice on our demo page.
What are honest alternatives to PatentPal?
If PatentPal is not your bottleneck, the sourced alternatives are Solve Intelligence, DeepIP, Patlytics, PatentProtector.ai, and a registered practitioner running a general-purpose AI model inside their own workflow.
PatentPal's own positioning is narrow and clear: it takes claims you already have and generates flowcharts, diagrams and description text, exporting to Word, Visio and PowerPoint. It does not publish prices and its team is small (PitchBook profile). If claim-to-spec expansion is your bottleneck, it may be the right fit.
In detail:
Solve Intelligence full drafting and prosecution workflow for firms, with SOC 2 and ISO 42001 and US/EU data residency.
DeepIP Word-native, aimed at attorneys who never leave their document editor.
Patlytics analytics, drafting support and litigation intelligence; useful when you need to know what else is out there, not just how to describe your own invention.
PatentProtector.ai a free provisional specification, a prior art scan across Espacenet/EPO-OPS and Lens.org, and USPTO/EPO/IPO export formats.
A registered practitioner using general-purpose AI in their own workflow. This is a real and common option. Note the difference in terms: a $20/month consumer subscription and a commercial or API agreement have different data-retention and training rules, and the filing party remains responsible for the document either way.
One thing to know when you read any of these roundups: the ranked lists are almost all written by vendors that place themselves first DeepIP, Solve, Patlytics, XLSCOUT and IP Author all do. XLSCOUT appears here as one of those roundup authors, not as a tool compared in the table above this page compares the six tools listed. Read the roundups for capability descriptions, then check prices and certifications yourself.
Where do all of these tools fall short?
No tool in this comparison guarantees a grant, and none removes the professional judgement from a filing decision. Grant is decided by an examiner applying the law to your claims over the prior art cited against them.
Three limits are worth holding in mind:
Prior art coverage is incomplete by nature. Espacenet, EPO-OPS and Lens.org cover patent literature well and non-patent literature poorly. A clean scan is not evidence of novelty see How to Do a Prior Art Search Before Filing a Patent.
Claim scope is a strategy decision, not a generation task. How broad to draft, what to keep as a dependent claim, and when to file are trade-offs an AI draft cannot make for you.
AI output needs verification. A fabricated citation or a mis-numbered claim will not correct itself at the examiner's desk, so check every reference and every claim term a tool gives you. One industry estimate puts AI drafting at 30–50% faster time-to-draft; that is a vendor-cited industry estimate, not a controlled study. Our view on whether the output holds up is in AI-Drafted Provisional Patent: Is It Good Enough?.
Draft your first specification free
The lowest-risk way to compare AI drafting tools is to test them on your own disclosure before you subscribe to anything. PatentProtector.ai generates a free provisional specification from a guided plain-English disclosure, runs a prior art scan across Espacenet/EPO-OPS and Lens.org, and exports in USPTO, EPO or IPO formats with optional review by registered patent professionals if you want it.
FAQs
Which AI patent drafting tool is best for a solo inventor?
There is no single best tool, but solo inventors usually want a free entry point and output that matches their filing office. PatentProtector.ai generates a free provisional specification from a plain-English disclosure and exports in USPTO, EPO or Indian Patent Office formats. PatentPal, DeepIP and Solve Intelligence are built around firm workflows and generally require a demo or a quote.
Is there a free AI patent drafting tool in 2026?
Yes. PatentProtector.ai produces a complete provisional specification before you pay anything. PowerPatent publishes token pricing (200 tokens for $199), so it is not free but at least public. Most other tools PatentPal, Solve Intelligence, DeepIP and Patlytics publish no free tier, so treat a 'free' tag in a directory listing as unverified until the vendor confirms it.
Can an AI tool be named as an inventor on a patent application?
No. Under the USPTO's revised inventorship guidance issued in late November 2025, AI systems are treated as instruments, similar to lab equipment, and only natural persons may be named. The Application Data Sheet must list natural persons, and a foreign priority application naming an AI as sole inventor will not support a US priority claim. Confirm your filing position with a registered practitioner.
How much does AI patent drafting software cost in 2026?
Published pricing is the exception. As of October 2026, PowerPatent is the only tool in this comparison with public per-draft pricing: 200 tokens for $199, then $1 per token. Third-party sources estimate PatentPal at about $50 per user per month and DeepIP at $350–420 per user per month. PatentProtector.ai starts with a free provisional draft.
Is my invention disclosure safe to upload to an AI patent drafting tool?
Only if the vendor answers specific questions in writing: SOC 2 Type II, ISO 27001, ISO 42001, GDPR posture and a data processing agreement, retention periods, whether your disclosure trains their models, and data residency options. 'Not published' is not the same as 'not certified' ask before uploading anything confidential.
Can I file an AI-drafted specification at the USPTO, EPO or Indian Patent Office?
Format rules decide this, not the drafting tool. The USPTO requires DOCX for the specification, claims and abstract of utility non-provisionals, and since August 2026 Patent Center converts DOCX directly to TIFF with a pre-filing preview. The EPO's 2026 Guidelines contain a dedicated AI section but hold the applicant responsible for the document's content.
